Terms of Service & Platform Agreement

Welcome to Rydealot ("Platform", "We", "Our", or "Us"). By accessing, registering on, or using our mobile web application, passenger services, driver partner portal, or "Along With" cargo matching services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Nature of the Platform (Technology Intermediary)

Under Section 79 of the Indian Information Technology Act, 2000, Rydealot is an electronic technology intermediary marketplace. Rydealot does NOT own, operate, or maintain any two-wheelers, auto-rickshaws, or cargo freight trucks. Rydealot does NOT provide transportation services directly and does NOT employ drivers.

All transportation, conveyance, and cargo freight services are provided directly by independent third-party Driver Partners who operate on their own account and responsibility.

2. Driver Partner Agreement & Subscription Pass Policy

By registering as a Driver Partner on Rydealot and clicking "Go Online", you explicitly acknowledge and agree to the following conditions:

⚠️ CRITICAL DISCLAIMER: NO GUARANTEE OF RIDES OR EARNINGS
The Subscription Pass (Daily Pass ₹29 / Weekly Pass ₹149) is a flat software platform access fee. It grants you non-exclusive digital access to our dispatch network, live GPS routing, and customer lead notifications. Rydealot does NOT guarantee any minimum number of ride requests, booking volume, passenger demand, or income. Passenger demand varies dynamically depending on live location, weather, traffic, and time of day.

2.1 Strict Non-Refundable Subscription Policy

Once a Daily Pass (₹29) or Weekly Pass (₹149) is activated, the technological service access is immediately fulfilled. All subscription pass fees are strictly non-refundable under any circumstances, regardless of whether you remain online for 10 minutes or 24 hours.

2.2 Independent Contractor Status

Driver Partners are independent contractors and commercial service providers. Nothing in this Agreement creates an employment, agency, joint venture, or franchise relationship between Rydealot and any Driver Partner.

2.3 Limitation of Financial Liability

Under the Indian Contract Act, 1872, Rydealot's maximum aggregate financial liability to any Driver Partner for any claim, dispute, or service dissatisfaction shall be strictly capped at the actual amount paid by the Driver Partner for the specific Subscription Pass in dispute (i.e. maximum ₹29 or ₹149).

2.4 Driver Responsibilities & Safety

Drivers must hold a valid Indian Driving License, Vehicle Registration Certificate (RC), Commercial Insurance, and Pollution Certificate (PUC).
For bike taxi rides, drivers must provide an ISI-certified helmet to the pillion passenger as mandated by Motor Vehicle Laws.
Drivers must pass real-time facial verification before going online.

2.5 Driver Fitness, In-App Reflex Screening & Non-Medical Disclaimer

🛡️ NON-MEDICAL & NON-FORENSIC DISCLAIMER:
The in-app motor-coordination challenges and cognitive reflex screenings (including the "Steady Road Tracer" and "Reflex Tap") implemented on the Rydealot Driver Portal are proprietary digital platform self-assessment tools intended solely to assist Driver Partners in assessing alertness prior to dispatch.

Not a Certified Medical/Breathalyzer Device: These in-app features do NOT constitute a medical examination, biological blood alcohol concentration (BAC) analysis, forensic test, or government-certified breathalyzer inspection.
No Safe Harbor / Absolute Driver Liability: Passing an in-app screening does NOT certify medical sobriety or waive legal liability. Under Section 185 of the Motor Vehicles Act, 1988, Driver Partners bear sole, non-delegable legal liability to operate motor vehicles strictly in a 100% sober and physically sound state.
Platform Safety Discretion: Rydealot reserves the right to restrict dispatch, enforce cooling-off rest periods, or deactivate accounts based on screening results, passenger reports, or sensor anomalies without liability.

3. Passenger & Commuter Terms of Service

By requesting or booking a ride through Rydealot, passengers agree to the following:

Prompt Fare Payment: You agree to pay the driver the full displayed trip fare immediately upon reaching your drop destination, either via Cash or direct UPI transfer to the driver.
Safety Compliance: Pillion passengers on two-wheelers must wear a safety helmet throughout the journey as per Telangana Motor Vehicle Rules.
Accident & Road Mishap Disclaimer: You acknowledge that transportation is provided by independent vehicle operators. Rydealot is not liable for accidents, delay, vehicle breakdowns, personal injury, or property damage during the transit.
Prohibited Conduct: Passengers must treat drivers with respect. Zero tolerance for abusive language, physical misconduct, or compelling drivers to violate traffic laws.

4. "Along With" (Cargo & Return-Trip Freight) Terms

📦 Freight Space Matching: "Along With" connects consignors (shopkeepers/senders) with commercial goods vehicles returning along designated highway corridors.

Commercial Vehicles Only: Only vehicles with Commercial Goods Carriage Permits (Yellow Board — Tata Ace, Bolero Pickup, Dost, Eicher) are permitted to accept cargo.
Strictly Prohibited Goods: Senders and Drivers warrant that cargo does NOT contain:
- Alcohol, illicit liquor, or contraband tobacco.
- Narcotics, psychotropic substances, or banned drugs.
- Explosives, hazardous chemicals, fireworks, or weapons.
- Unaccounted currency, gold bullion, or stolen property.
GST E-Way Bill Responsibility: For consignments with a commercial invoice value exceeding ₹50,000, the sender and driver are legally obligated to carry a valid government GST E-Way Bill under Rule 138 of CGST Rules.
Transit Loss & Damage: Rydealot is not a common carrier and assumes no liability for goods transit loss, spoilage, or damage. Senders are advised to obtain transit insurance for high-value goods.
Platform Token Fee: The flat ₹49 booking token fee confirms vehicle reservation and is non-refundable upon truck dispatch.

5. Operational Geofence & Service Boundaries

Rydealot Passenger Taxi services are strictly authorized and geofenced to the Warangal Tri-Cities jurisdiction (Warangal, Hanamkonda, Kazipet, and contiguous limits within 25 km). Rides requested outside this approved municipal zone are strictly prohibited.

6. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, claim, or controversy arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Warangal, Telangana, India.
